My Receipt Date is of January 2003, done with 2nd FP still no approval :(

Depends ... what's your 485 ND (not RD)

If your ND is more than 30 days before the "now processing" date (which is 7/1/2003), then you can open an inquiry.

btw, if you are EB3 (doesn't matter which country u are from), then because of the visa number unavailability, your case won't be processed from July 1 - Oct 1
 
My 485 ND is in the last week of june 2003, so I guess I will have to wait another month before I open a query. right ?

Indochinese Adjustment act

Hi,

I see that processing date for NSC I-485 is July 01, 05 for employment based applications, whereas under Indochinese adjustment act it is March 01, 05.

My application is employment based and I am an Indian. Which date applies to me?

Confused on the Visa number unavailable Vs I 485 processing date of July 1st

I have my I 485 pending from Sep 2003. My PD is Dec 2002. How Do I relate the Visa number unavailable and I 485 processing date of July 1st 2003? If the I 485 processing date moves to Sep 2003, would my case be approved? Or should I still be waiting for the Visa number availability?

Does any one know how long the vis number will be unavaialble? Is ther any guess on when PD of Dec 2002 will be current

Am assuming the following 2 things
(1) your case is EB3 -AND-
(2) Your country of chargeability is one of India/China/Philli

Your PD was not current starting from Jan 2005.
So, your case will not get touched till at least Oct 1st, 2005 -- that's when the uscis "new" year begins and they will start looking at EB3 again. (so EB3 unavailability is from July 1st till Sep 30, 2005)

The current PD cutoff is June 1st, 2002 -- you can expect that your PD might become current sometime after Jan or Feb of 2006.
(This is assuming that no new provisions come in place and the PD movement is like the last few months -- I hope we'll get some EB3 relief - but its a long shot anyways)

I filed my I 485 in Sep 03 . I have not received my receipt notice. I called customer service . I got a letter in October 2003 saying that my case is pending. The letter also had LIN # on it. After that I have not received any communication from them. Meanwhile they approved my travel document and EAD twice. When I called customer service they said my case was rejected on Sep 2003 itslef and the reason they say is the check is not signed. I verified the check and it was signed and it was cashed as well in Sep 2003 itself.

But I have not received finger print notice yet. Also my case is not available on the online status check. My wife who filed along with me got first finegr printing notice in May 2004 and second finegr printing notice in May 2005.

I sent couple of letters to Service center explaining my case. I have not hear anything from them. I do not have an attorney because I filed by myself with the help of my employer (that's how my employer does for everyone)

Does any one have any ideas how to approach Nebraska Service center to get my case moving?

It looks like my case is in rejected status, so even if my PD is current my case would not move.

I have another question does any one know what was the FILING FEE for the I 485 in Sep 2003? My employer check has an amout of $ 255. Is that the right amount at that time for the I 485? I am just wondering if I did not pay required filing fee?


NO Receipt Notice
NO Finger print notice
NO rejection notice (Though customer service says they sent a rejection notice)
NO Online status

Any suggestions would be helpful
