Hi - My first H1-B was at University (Cap exempt). Later, I transferred my H1-B to Company A and then to Company B (Both Cap subject).
But, When Company A and Company B filed for I-129 In the H-1B data collection supplement form, they had not checked “YES” – Beneficiary has worked for University or non-profit before (Part C, option 6).
I believe, I was never counted against CAP
I am planning to transfer my H-1B yet again and not sure where I stand? Am I out of status because it was not counted towards Annual Cap due to filing/administrative mistake? Do I need to take any steps or other action to correct his or file the H-1B transfer the same way it was previously?
