Hi Folks
One of our friends whose I-140(under alien of extra ordinary abilities) [independent category] was approved. He went to India before submitting his I-485 and approached to the US counselor for his H1B stamping. There was unusual delay in the process and he finally got his H1B visa stamped after 90 days. Unfortunately by that time he lost his job here in US. As per the H1B regulation, he can not come to US although he has valid H1B but no job.
Now he wanted to know the following things.
(1) can he go for Consular processing of his approved I-140 in India
(2) How long approved I-140 is valid
(3) He is in India since last two years.
(4) He is a Ph.D graduate from IIT Mumbai in Biomedical Engineering and still actively maintaining his science and research career in India.
