Need help on EAD usage. Thanks.

Hi, all,

My 6th-year H1B will be expiring soon and I am thinking of using EAD.

I am wondering what document I need to file with my company HR. Do I need to file anything with USCIS? Does my company need to file anything with USCIS?

Download form I-9 from USCIS site and send it to HR. They need to keep it for their records.

I-9 form is for company records, as far as i know you or HR no need to send any document..

Hope you are married and you don't need to sponser H4. In that case you can use EAD.. If your company is willing to apply for H1 extn, then I would apply for it..

Starting time for EAD in I9.

Hi,

I only filled out one I9 when I joined my currrent company five years ago. At that time, I only had H1B.

After that, I got both H1B and EAD due to the filling of I485. I haven't filled up I9 again since then. I am wondering if this is a problem.

Also, If I go with EAD now, how can I specify when I would starting using EAD instead of H1B since I had both in the past.

Your newest I-9 would supersede all previous I9s.
So the "start" date of the EAD is the date on the I-9 form that you filled up showing EAD as your proof of eligibility.
 
If the I-9 is only for employer and not USCIS...what is the need to even file it? Just playinig devil's advocate.
 
Randomly INS will ask for the employment verification from the employers.. So they have to keep all I-9 up to date.. It is their responsibility..
