I am working for Company X from Jun, 2005 but my LC was filed in Mar, 2004. I got my LC for Software engineer designation but for I-140 my Attorney wants the CompanyX to submit W-2s of Software Engineer employees from 2004 and 2005, I did not join by then, Company X has no such W2s.
My attorney says Company X has to prove the ability to pay since 2004( & 2005) even though CompanyX can prove the ability to pay for 2006 and 2007 based on good financial statements for last two years.
I have provided my W2s for 2005( from June- Dec 05 not full year) , 2006 and 2007.
Any suggestions would be greatly appreciated.
