J1 waiver to GC

Iwill complete my J 1 waiver on June4-07.
My wife just became a US citizen
My I 130 thru my wife (when she was a permanent resident)was approved 2 yrs ago
1. Should she upgrade my old I 130 or file a new I 130?
Which would be quicker ?
2. I intend to complete my 3 yr waiver. Can I file I 485 and I 175 (EAD) 3 months before my 3 years are over ?

1) no, she does not need to file a new I-130. It was approved, and as long at the relationship exists, it will be valid.

Your wife should send a copy of her naturalization certificate to the NVC as soon as she gets it with a cover letter and a copy of your notice of approval. Your I-130 will then be directed to the consulate in your country.

2) HRR is two years. What 3 year waiver are you talking about?
