I am on F1 visa and is in a graduate program in computer science. I
will graduate next year and all with most computer forks, the job
market is terrible. And i have to leave U.S upon the completion of 1
year
OPT.
I am thinking of applying for asylum 6 month after I
graduate if I still can not find a job by that time.
I understand the chance of being approved is almost 0 b/c I am in U.S
for more than 2 years. But I think I
will be able to stay in U.S legally until the application is finally
denied. And in the meantime I will get EAC and can work
legally. Then I will have more time to look for a job. And hopefully
the job market will improve in that time.
There are rumors saying that the processing on asylum will be freezed
now. Is it a good news and bad news? does this mean the application
will be pending for ever? meaning that the applicant can stay legally
for ever? or does it mean the asylum application will not be received
anymore? But I feel very unsure about the plan and not sure whether it
will
impact my application for H1 and green card if I find a job while
waiting for being denied by the asylum. Besides that, what negative
impact could this move cause on me?
Again, I feel it is like a suicide move some how.
Thanks a lot for your advice. Pls help this suiciding guy!

Well your rumours may be wrong...Unless they scrap out the 1996 Immigration Act, asylum cases wont freeze..They have to interview in 6 months after your inital application. Another reason YOu may be approved is because you are in U.S legally and the 1 year asylum law shouldn't apply to you..maybe I am wrong but there are lots of Chineese students who come to study here and when graduate apply for asylum..Maybe I am wrong..I think others can give u some advice..

But it can take upto 2 years to get deported..Make sure your case is strong..

first of all, with few exceptions, one should apply for political asylum within a year of arrival to the USA. These exceptions include sudden change in the political climate of the applicant's country
Second of all, if you are using asylum to stay in this country, rest assure that you will not succeed. your asylum application will be only accepted if you truly fear persecution if you return home; something you did not mention in your post.
Third, you cant have it both ways my friend. After september 11th, the country has become extremely anti-immigrant and adjustment of legal satus is not as easy as it used to be.
fourth, here is a kicker. let us assume that you were granted asylum a month from now. first you have to wait a year to apply for your green card then you will have to wait 13 years to get your green card.

Now i know you said you are suicidal and you want to stay... my advice is : either find a nice American girl to marry or apply for as many positions as you can. there is another forum that discusses employment based green cards in this web site. visit them they may give you advice.. good luck and i am sorry for not giving you good news.
