Is AC21 job description okay

is a letter describing the job responsibilties on a comapny letter
head from a technical manager okay for doing job comparisons.

-- My job decription in LC is that to reseach and design
software systems.

My duties are way beyond that in my cuurent job.

Will the same lines on a company letter head
be acceptable form of comparing job descriptions.

HR of the company gives only a general detail
on jobs ( genral for everyone)

Also, in case of denial of I-485 based on job description
( what % ) what are the alternatives to stay in USA>

Does a person get time to apply for new H1-B ?

How much time for appeal of Notice of denial.
 
I have not heard nor have I found any examples of anyone being denied based on dissimilar jobs under AC21. The term "same or similar classification" gives a lot of room for a "good faith interpretation" in comparison of LC and current job descriptions. I think unless the jobs are obviously different, like Accountant to Pharmacist, AC21 apps should be fine w.r.to. job descriptions (e.g. software engineer --> software developer). It is understood that duties, responsibilities, salaries do increase with time and that is where the "good faith" interpretation comes in.

I think if you can list the skills involved in your new job (which will match the ones in the LC), it should bolster your argument for a "same/similar" job description.
 
dissimilar jobs?

Currently I am a research associate in university, doing research on structural engineering. If my next job is a geotechinical engineer in a company. Will that be considered similar or dissimilar? Both are under the general area of civil engineering.
