DOL can only investigate if an employee complains or a third party who has enough information to file a legitimate complaint that there is violations.

The interesting thing is that there is a wall between USCIS and DOL. If USCIS in their adjudication of benefits sees violations (ie., non payment or low payment of salaries, they are not allowed to refer it to DOL.

This is one of the things that they are trying to change to get rid of this wall. Once this wall is gone then so is percentage basis income, bench time, etc.

Have you ever gone to "programmersguild.org"; they are totally against h-1b and are making a lot of noise with government on how it is being abused and how us permanent reisidents/citizens are being discriminated upon.

They filed complainst on over 300 companies for discriminating against US citizens. Department of justice is investigating and there will be considerable fall out when everything is said and done.

A big word of advice is that with this retrogression going on; many things can happen until greencard ultimately gets approved. USCIS is revoking approved 140's and with all these investigations; nothing good is going to come out of it for people who went through consulting companies for greencard. It would be very wise to stay on h-1b until greencard ultimately gets approved. You will have much more options, just in case something should go wrong.

This has been going on and on. The infrastructure is big. People purchased labors and moved on to new employers using 180 day rule on EAD. People are crazily invoking AC21 180 day rule and moving on and buying houses etc..... Folks seem to move on and go with flow. But if crackdown is in place it will be interesting to note the progress. People have been in consulting jobs for ages and still do consulting because they prefer to do it. Most of my American friends do consulting. I am of strong opinion that as long as wages and job location and position everything is valid and abiding to laws, then there should not be any problem. But you know better, so lets see how things move.
