I want to send complaint to Miami Office

Hi, All

My wife's and My 485 cases were filed March,2002. After 800+ days
wait, the all mighty TSC transferred them to Miami on July, 2004,
instead of approving it directly (My friend working in the same company, filed at the same date, got approved directly 3 months ago)

SO I called Miami office in order to check my case, a polite lady answered
my call, but she refused to give any information on my cases "due to security reasons" (which is really ridiculous since the national service center
can do the case status check). The only thing I can do is either call
that national service center (which I am sure it won't help because
all they can do is just reading the same website which I browse every
day.) or schedule a infopass appointment. I told her why can't she just
do it over the phone instead for me to drive 2 hours to Miami and get
a 2 minute talk with a officer. She just said it is the rule followed by CIS.
I told her I don't like this rule and want to file a complaint. To my surprise,
she gave me a FAX number saying I can file my complaint to this supervision
agency.

Then I told her that the CIS official website claiming that Miami Office is processing I485 with filing date of March 2003, which is one year after my
case's filing date. She just said "backlog problem actually exist, what we
claim on the website doesn't gurantee your case be processed, it is just
average processing date of all the cases we are processing".

Anyway, I am planning to file a complaint to that fax number indicating
I want to make case inquiry by phone instead of driving to Miami. I am also
gonna complain my case is one year older than the official processing time.

Do you guys think it would help? Or should I just call national service center
to make case inquiry?

Your case file will take about a month to make it from TSC to Miami. Until then, complaining will do nothing for you except waste their time and yours. I doubt they'll let you do an inquiry by phone. Try it in writing 60 days after your case has been transferred.

Thank you so much for your advice! I think I will follow
your suggestion to wait for 60 days before I send complain
to them.

If you don't mind, could you please tell me:

1. what was the RFE you got in 2002 asking about?
2. what is the reason your case has been transferred?
3. which local office your case has been transferred to?
( seems you have waited for about 2 years before the local
office schedule interview for you, which mekes me feel really COLD)

BTW: Congratulations for your recent approval

Thanks again!
