My 1st H1B is expiring on Decemeber 19' 2003. My employer applied in Vermont Center for my I-485, I-140, Advance Parole, EAD in January 2003. I got my AP and EAD in May 2003 which is valid till May 2004. My I-140 is still pending. I'm working on EAD now. I'm concerned about my I-94 that gonna expire with the H1B, the expiry date is Dec 19 2003. Am I gonna be out of status? Do I need to go for the special registration? My friends that travelled to Bangladesh asked the INS official upon their arrival back at JFK, and INS told them Not to go for registration b'cos he is same like mine situation except this that he has a valid H1B visa till May 2004. What do U guys think about it?

Please answer these questions, I'll be really thankful to you.

1) Am I gonna be out of status without valid I-94?

2) Do I need to go for the special registration this coming year
too?

3) Do I need to renew my H1B mandatory?

Thanks

No, you won't be out of status. Since you have applied for I-485, you have a valid status.

2) Do I need to go for the special registration this coming year
too?
Sorry, can't answer that.

3) Do I need to renew my H1B mandatory?
Its not mandatory. Its upto you/company to do it. But since you have already started working on EAD, you have lost your H1 status. Now you won't be able to extend it (your old H1).
