I-485,EB-2, PD current.....cash pending.

hi,
here is my sign.

labour PD : 01/02/2003 (EB-3) closed case ( EB-3 ) : 12/15/2004
labour PD : 12/08/2004 (EB-2)
labour approved : 03/05/2007 ( EB-2)
I-140 Applied : 03/15/2007 ( TSC )
I-140 approved : 03/23/2007 ( TSC )( EB-2 )
I-485 Applied : July,2007 ( TSC )
Receipt date : 08/31/2007

i have master degree.and i have approved I-140 in EB-2. so my I-485 case is in EB-2. my priority date is current more than 60 days and my i-485 is pending. so i call congress man about my case status. they send me a latter........

In response to my inquiry on your behalf, I received the following information from the United
States Citizenship and Immigration Services (USCIS).
The USCIS stated according to the approval notice, the 1-140 was approved for a Member of
Professional with Advance Degree or Exceptional Ability, Section 203 (b) (2). This section of
the law classified the employment based petition as second preference. The petition was
accorded a priority date of December 8, 2004 which under the second preference, a visa number
is currently available.
According to the USCIS records, they learned that the 1-140 petition was actually approved for
the third preference category. The petitioner (********* Inc.) filed the 1-140 as employment
based second preference; however, the beneficiary did not qualify for this preference. Instead,
the beneficiary qualified for the third preference category; therefore, the petition was approved
for this preference. There is no visa number available for employment based third preference
from India for you at this time. This is the reason that your 1-485 application remains pending.
The petitioner has an option of requesting USCIS to adjudicate the 1-140 petition for the
preference category filed (second preference) with evidence of the beneficiary's qualifications or
retain the third preference category granted and continue to wait for the visa number to be
available. They cannot speculate the outcome of the petition if the second preference is
requested. A correct approval notice form 1-140 will be sent to the petitioner to reflect the third

my lawyer says :

We have done the follow up with immigration. There is only one more thing we can do is to liaison with the immigration with your organization. If you want us to do that it is going to cost you $500.

my question is
(1)what is liaison ?

(2)i have master degree. plus more then 5 years experience. and i have approved I-140. why uscis says the beneficiary did not qualify for this preference.
