I 140 rejection

My lawyer filed my I 140 this Feb 2008 and due to the technical error from his side, it got rejected in Aug 2008. He has sent the application again in September 2008 and it is under process.

I and my employer was not notified by the lawyer about this. When I called him, he not even sensitive to this issue and simply said it is a technical problem which offended me to some extent.

Now Is there a possibility to make this latest 140 filing premium? please let me know

If you have 60 or less days remaining in your existing h1b then you can file I-140 premium along with proof of status expiration
