Hi,

I am on EB2 - PD Sep 2006. BE plus 5 years exp.
My 140 was denied recently because of not showing proper progressive experience.
I am planning to file a MTR with new experience letters.
I am on my 5th year completion in July.

Meanwhile, I am getting an offer from another company and planning to join there.

My question is

1) If I convince my original employer and he agrees to file my MTR for 140 and continue that, can I join another new employer?
2) Is it legally possible to continue 140 in old employer eventhough I joined a new company?
3) Also, is it advisable to do like that?
4) Will it create more confusion for my 140 MTR and my Green card processing since I already quit the company?

Please advise

Thanks
-M

Answers below:
1. Yes you can, and this will fetch you H-1B extension beyond 6 years (provided the appeal is still pending or approved) if necessary.
2. Yes, as employment based GC is for future employment.
3. Well the GC case will become slightly complicated ...
4. No, as long your current employer backs you up ...
