Hi,
I am currently in US. I am on a H1B visa in my 5th year, my wife is on H4, my daughter is a US Citizen. I have just changed my job and have applied for H1 transfer. I will be applying for a Green Card with this employer. I will be based in USA and will not be relocating to Canada. My new employer has projects in both Canada and USA and is applying for my work permit to work in Canada. After my Work Permit for Canada is approved, my employers are intending to assign me to a Canada project and expecting me to travel weekly. My question is as follows:
Since H1 transfer process has just started and approval has not yet been received, will I have any problem in coming back to USA on I-797 visa that is with my previous employer. Since I will be on work visa's in both countries, can I travel in and out of both countries. Is there anything in the immigration laws of both countries that prevent this.
I will really appreciate any guidance on this. Thanks in advance.
