H1b to F1 when PERM has been filed

Hello,

Here's a brief summary of my current h1 status:

Currently on H1.
PERM filed - Jan-2013
Category - EB2 (5+ yrs experience)
Current location - US

I may be offered admission by a US university in the next two weeks, so my questions are-

1) Can F1 visa be rejected on the grounds that I already have a PERM going? Do I need to take any extra steps while filing F1 because of my PERM?

2) If F1 gets rejected, can I continue on my H1 with the PERM going the way it is today?

It would be great if I can get answers to these questions.

No immigration intent on F-1

I think that you are not supposed to have immigration intent if you are on F-1.


In other words, applying for F-1 visa could threatened your Green Card application.


I have read that one of the proposal of the immigration reform will attribute F-1 dual intent. If the law passes, F1 could then have immigration intent.
