Came to USA:Dec-11-1999
Current H1 Expires:March-20-2005
Total time spent on H1 by March-20-2005 = 5 Years 3 months and 9 Days.
Time left left on H1 = 8 months 21 days.
Vacation to india : May-1-2003 to May-24-2003 = 24 Days.
Total time planning to ask for extension : 8 months 21days + 24 days = 9 months 15 days.= Jan-05-2006

1) Is it reasonable to ask for the extension for 9 months and 15 days alone?
2)I have an LC pending more than 365 days.So is it better to apply 1 year extension + 9months and 15 days?

Please advise your valueable suggestions.Thanks for the help in advance..

---- that is OK let the lawyer explain on cover letter when you entred and when you were out with dates and provide the copies of your passport pages that have US entry stamps and your home country entring stamps

----- Better apply for what time is remaining on 6 year H1, once that extension is approved then apply for 7th year H1, ask your lawyer how he is going to do, becase USCIS said something in your kind of situation but nothing is published as MEMO or law. I hope your lawyer knows what to do.
