H1B Expiring. Want to file for EAD

My H1B will be expiring in August 2009.
My I140 is already approved and I want to file for my initial EAD.
Can I file for my EAD in April or is there a waiting period before my visa expires.

Please help.

If you have pending I485 you can apply to get EAD any time you want and has nothing to do with H status at all.

This is what EAD suppose to be mainly. For those with no current priority date by which they can work. Go ahead and apply if you want. Thousands out there have EADs without PD and even not using it and keep renwewing H
 
Thanks for the reply. I have one more question: can an EAD be rejected or denied for some reason. If yes, then can we reapply again or would the case become more complicated.
