H1 extension. after what?

Is H1 extension one year after Labor certification even without filing I140? or only after filing I140? Is it finalised yet? Thanks.

Hi,
I came to US on H1-B from company A. Later I changed my employer to B. Employer B has applied for transfer of H1-B and I received new H1-B papers. On my passport I have visa with the company A having expiry date Nov 2001. Now I am going to India. My question is whether I can come back to US on my existing VISA on my passport which is with company A, but right now I am working with company B. Or is it necessary to get new VISA stamped while coming back to US from India.
Seeking guidence at the earliest.

You don\'t have to stamp a new visa as long as you are within the expiry date of the existing visa. When you enter, you can show the Company B (latest) approval papers so your I-94 will be dated on it\'s expiry date rather than Nov 2001. After you come back, you can send the approval notice to St.Louis to revalidate.
