I entered US in 2008 having a B visitor status. Just before my status expired I went back to Russia in April 2009 for 2 weeks, then I came back to the states and got new status for another half a year.
While still on visitor status, I got sponsored for H-1B. My visitor status was due in the beginning of October and my employer requested H-1B from October 1st. However, they received our paperwork on October 5th and status issued was good from November 3rd.
It was absolutely legal to wait for new status approval/denial while being out of status for few weeks, at least according to immigration and naturalization services. But it looks like I can't get my visa stamped in Canada/Mexico because of the case.
Information I found on immihelp.com website states that "someone can go to Canada or Mexico for visa stamping if they never were out of status". Is this true?
