I am in a strange situation and I am not sure what I should do.
Here is the time line:
1. Labor priority date (future employment): Feb 14, 2005
2. Employer applied for H-1B Oct 01, 2005
3. Got the H-1B approval till Oct 10, 2008
4. My actual 6 years expiring on July 01, 2007
5. Got Labor Approval Jan 17 2007.
Now my concern is between 3 and 4. My employer says that they applied for my h-1 showing that labor was pending, but my concern is it was not pending for 365 days.
Is it a mistake of INS that they gave me extenstion till 2008 ? What is the best course of action now ?
