Hi,

I am going back to India after spending 6 years here and my last date here in April 24th, next month. I am planning to book my tickets on 23rd. In case if my flight gets extended for some unknown reasons and I have to leave on 24th or 25th, does America let me be here for a day or two extra? Is there any rule with which I can avoid being statusless in this country?

Please advice.

Thanks for the reply. So, you mean I do not have to let the immigration know that I am overstaying here?

Thanks again,

Always consult an attorney to be sure. Your overstaying might affect your future trips to US. As far as I know, it shouldnt as long as it is less than 6 yrs. But talk to an attorney!

Are you on H1B status?
If so, you can leave within 10 days past the expiration of your petition.

If you are still employed in H1 visa, and want to go back home, its employer responsibility that s/he will take care of your flight arrangements. If they fail to do that, INS will get hard on them. I really dont know about intenstions, if you want to come back or no, but if not, you can ask your employer to do that.
