First time Traveling on AP

Hi,

I am travelling on AP for first time to Hyderabad (india) via Amsterdam.

My questions are

1. Do I also need to show my AP documents while departing USA?
I have I-94 (expired) do I have to give this to customs while departing?

2. I Have three copies od AP's sent by USCIS. Do I need to give all of them at the port of entry? or only one is enough?

I have a similar question..traveling to Hyd and planning to use AP for the first time. what documents should I carry with me?
 
Same question. Planing to use AP. What doccument they ask for. As we are in I 485 pending and have EAD/AP, our TN is expired (We didn't renew it). Do they ask non-immigrant visa?

I learned from some other thread that we need both the copies of AP(make copies for your self as backup), 485 recepit, passport . In addtion carrying employment letter(just in case) & EAD also doesn't hurt. (I don't see a reason why they would ask for these.).

Does any one know what would be the status of my H1(valid till 02/07 but no visa stamp) after I enter US using AP?

1. No, all you have to do at departure is to hand in your I-94 to the official collecting them.
2.Make a photocopy of your AP and 485/140 notices and keep them as a back up should your travel document be stolen or misplaced. On your return journey, the airline official will have to see the AP document view it and return it back to you.Some airlines do copy it but they are not entitled to any original copy.
At the port of entry stay on the que for visas, you have to let the CBP official know you travelled on AP while handing him your passport.This is to save time so he or she wont start looking for a visa in your passport.Once you hand over your document(passport and three copies of AP) you will be escorted/directed to an office for secondary inspection. They will go and double check your AP and confirm you are an adjustment applicant. Once your status is confirmed they will stamp "paroled until 1year from that date. The stamp will say adjustment applicant and purpose ..... depends if you are the primary or derivative applicant eg DA I-512. the officer will also write a set of numbers to identify himself.A copy of the AP will be retained and they will return 2 stamped copies to you and tell you how to subsequently use your AP.Have a safe tri
The process is very straight forward and there should be no unecessary anxiety. You wont be finger printed so do not bother about that.

If you haven't ever used EAD while you enter using AP, your status still would be h1.

There is a misunderstanding about this but it's confrimed that your status won't be changed from h1 to EAD unless you use EAD.
Read Cronin Memo -- this is from the legacy INS.
 
I am also planning to travel in near future Now since AP is taking so long, applied last week. Would it matter if somebody mails me the approved AP?
or else should I apply for H-1 visa renewal?

Does pending name check affect H-1 visa renewal time etc?

YES. IT would matter. Person MUST be present in US while AP is approved. you can't have someone mail you.

Applying for h1 renewal would be a wise decision.

This brings me to the question 5 in part 3 of I-131 application, where it asks for where the document is to be sent? It does list American embassy or consulate as one option?

Can't this be used ? Any body used or talked to lawyer about this?

1. No, while going back to India, the bording pass issuing officer will take out your I-94.
2.I travelled twice on AP, first time I landed at JFK and the officer put a seal on I-94 and on ONE copy of AP and returned all three (one with stamp and two un touched), second time I landed at Chicago, Officer put the stamp on all three copies of AP and returned all to me. In sum, its very straight forward procedure and need not to be anxious, let the officer do whatever their way of job, give them all three copies and see how he did. You can travel as amny time as you can even with stamped AP within their validity period.

Advance parole

When someone gets an advance parole do they give a new I-94 or is it the original you have when you enter w/ visa because out I-94 is expired and does advance parole treated different for different countries?
 
what happens if 485 status becomes intent to deny/denied

Say AP is approved and the person went to india.

In the meantime, 485 became either intent to deny/denied?

can he come back to U.S without any issues??

any idea?
