Does anybody know if the First time homebuyers credit can be used by foreign national without a green card? (example: us on a TN)

Thanks :)

Yes. As long as you file a 1040, which TNers living in US should. Note that even if you recently owned a house in canada, you still qualify.

Does the mean H1B holders can get this First time homebuyers credit?

It seems everyone can get it as long as you file 1040.

thanks.

I am on H1 and I already got it when I filed my taxes in April.
For tax purposes, as long as you lived for 183 days of the tax year in the US, you are a resident as far as IRS is concerned.

Its not quite that simple; even if you moved yesterday to US, you could still qualify.
Tax questions are best asked on forums.serbinski.com
