I have question about my fiance'
She came to US on F-1 visa on June 2000.
She filed for 245I in Feb 2001 on family base. Her F-1 visa will be expiring next year.There is certain requirement for international students to maintain
their status in the US as per INS eg the students have to take 12 credit hr
per semester to be in good status. I cant say with surety if she is out of
status.
I have my adjustment of status pending I have got approved my I-140 recently, My labour was filed in Nov 2002. My question are as follows
1- If the person is 245i beneficiary then would she be able to get add
on her husband approved labor when I-140 is approved.
2- What is the procedure for this person who is 245 i beneficiary to be
eligible for green card when the husband has approved I-140 and labor certification.
I inquired about it to my lawyer as he said I cant add her in my GC process as she is 245I beneficiery before I filed for my labour certification.
Your help will be highly appreciated.
