folks, I am starting a new thread for people, who have filed I-130/I-485 with MSC/NBC , because they are married to USC. Please post your application/time line/interview experience. Please share for benefit of others who are in same boat.

Thanks

130 and 485 recieved at NBC on 5/28/04, prints appointment for 6/8/04, results of prints recieved by NBC on 6/14/04

130 and 485 received @NBC on 2/25/04, fingerprints done on 4/16/04.

filed through NYC office and I guess paperwork got transferred to NBC b/c case # begins w/"MSC"

what processing dates should I look at on the website? dates for NBC or NYC?
either way, it'll probably be a while.

you should use NBC, however they dont show correct time for 130 or 485. I was told 30-90 days for I-130 processing and 30-180 days for I-485 processing.

I just sent mine in to the NBC last week (via Boston). What have been people's experiences in getting the EAD??

thanks much!

INFORMATION ALERT

REUNITE SEPARATED FAMILIES

We Want Your Support!

Greetings from USINPAC!

This week USINPAC has come out to seek public support on an issue which is causing severe anxieties among the members of the Indian American community.

*

‘Family Reunification’, as an issue, has affected over 50,000 lawful permanent residents (LPRs) of Indian origin who have been separated from their spouses and immediate families due to the long immigration processing times.
*

The V-Visa program that was created as a temporary solution to this problem had come as a boon to such families. But unfortunately, it was available only to beneficiaries of I-130s filed on or before December 21, 2000 .
*

The extension of this Visa program has become necessary so as to expand its benefit to a larger section of LPRs, who might otherwise take as long as 6 years to be reunited with their families.
*

Although introduction of a permanent and a more fundamental legislative reform to speed up the immigration application process is desired and required, it can be rather extensive and prolonged.
*

Therefore, as an immediate solution, USINPAC is vehemently gathering support towards extension of the V-visa program for an additional five-year term. Please sign the petition http://www.PetitionOnline.com/usinpac4/petition.html and ensure your valuable support.

Please forward this email to your friends and family members and help us gather support from more and more Indian Americans on this issue.

Chicago District Office to NBC
Mailed I-485 w 130, 131 and 765 on 5/26.
Received a receipt notice from MSC/NBC on 6/10 w ND of 6/9 and RD of 6/1.
Still waiting for Priority Date notification.
Fingerprinting set for 7/24.

Ron, Where did you hear 1-6 months for 485 processing? Can anyone corroborate? That seems like a sudden and phenominal improvement! But I'll be happy to hear it if it's accurate.

What's going on with I-130 in MSC

Filed I130/I485 to Charlotte, NC in Sept 2003, got receipt from MSC in Oct, 2003.

The on-line status says it will take 30-90 days for I130, now 200 days passed, nothing is received. Called 1-800 number, was told the date on the web was inaccurate, we should follow the processing day for MSC. It looks like it's still processing 11/1/2002, and it's been stayed the same date at least for the last 3 month. Does anyone know what's going on?

Thanks

The entire system is messed up, the 800 number give you a bunch of bad information. I talked to them many time and they always mess things up. The 11/1/2002 date has been there for almost a year. Its never updated for some reason. I wish we can know what is accutally happening.

I-130 in MSC

I would love to hear of somebody who has been actually approved recently for a I-130 at the MSC. I am a USC, my wifes I-130 was originally filed at the TSC in 12/2001 transferred to the MSC in 4/2003. According to the processing schedule they have been stuck at 11/2001 (at least for family based I-130's) since the later part of 2003.

Petition for Mother

Hello,

I had filed for my mother's I-130 in July 2003. I am a US citizen. I had heard such cases are processed in less than a year.

Last week I got a letter stating prove My mother is my mother. Her name is real. We had sent most document they had asked for. Now it is not too clear what additional documents are required.

In India, on most of my school certificates only father's name is given. He is no more and they did not have marriage certificate.

Let me know what additional documents can help.

Do we have to go for blood test or what they call Antigen Test. The letter did not ask for it but I heard few cases where it was performed.

Thanks a lot for all your help.

Regards.

File transfer in Family based case

Hi

I am F1-> H1b ->married to US citizen -> filed (I 485 + 130) in Detroit Michigan in Dec2002.
I got my EAd from the MI office.

I got a very good offer in Pa in Oct2003( by that time I had got nothing except for the reciept notice from the Detroit Office) and took it. I got my files trasferred from Mi to Philadelphia Office in Nov 2003. Worked my a$$ off to get my EAd renewed at the phillly Office. Initially they weren't even able to find my file.

The current status is : I haven't received anything from the philadelphia office...not even an acknowledgment of the file transfer. No letter regarding FP...nothing at all...

Has anyone else had similar experience(specially with Family based immigration..thought they were suppose to be hassle free)...

I read about files being tranferred to *SC from your local district office...is it customary ...i was told that the district office handles such cases.

thanx a ton for your help in advance

Hi Sachin,

My wife and I face a very similiar dilemna. I'm a US citizen, and my wife's 485/765 was filed in NYC and was routed to NBC. problem is that w're moving to philly for 2 years for grad school. not sure if we should keep the paperwork as is, or file a change of address. i've heard that the change of address can be a nightmare.

regardless, based on conversations I've had w/CIS officers on the 800 #, one should receive a confirmation in the mail (at your new address) that the file was transferred. I would definitely follow up w/them at the 800 #, or with your local congressman's office in Philly.

My Timeline

My timeline is as follows:
MArried to a U.S citizen
Applied to Houston INS and was transferred to NBC I-130/I-485/I-864/EAD/AP
all together.

Receipt Date: Nov 7th 2003
FP: January 15th 2004
EAD: MArch 15th 2004
( No interview card came in the mail)
Advance parole: March 15th 2004.

Nothing since then.

Thank you for starting this thread on NBC

Submitted to Philly office

I have I-130 approval notice from my father (a USC). I submitted I-485, I-131, I-765, to Philadelphia district office, they forwarded to MSC.

Received: 6/15
Notice date: 6/25

Fingerprinting scheduled: 7/9

how fast ...

We filed our application on 4/26/04 and RD was marked as 5/7/04. ofcourse Receipt numbers start with MSC, which means MSC did initial processing like collecting fee etc. I did my FP on 5/22/04 and after that my file was updated 3 times and LUD being 6/8/04.

I do know that I-485 is handled by local Service center in such cases. At sp. paul the processing date for I-485 is 2/12/04, which is about 3 months away from our RD. Recently there was a memo, which instructed 4 major service centers that they should locate and send I-130 and other stuff to local service centers, if local service center pulls up I-485 application for processing. (source murthy.com)

Without being optimist here, if that is true, for those who filed in St paul should see some activity in next few months. Also I agree with others observation that processing time (30-90 days for I-130 and 120-180 days for I-485 ) does not seem right. I have looked at other website and found that processing of marriage based cases varies greatly depending on what your local service center is. But in states like Montana, MN, WA, people's case has been adjusted with a year or so.

Any comments are welcome.

Chicago transfered to MSC (I-130 and I-485)

Both of my husbund's I-130 and my I-485 are now at MSC.

RD: 06/17/04
FP (I-797C notice): Told me to schedule it myself by calling NCSC.
The receptionist their gave me the first available date (07/20/04) at ASC (Pittsburgh)

Still the on-line status says: "Rejection of resubmitted FP fee". I've never submitted it twice and further got mail to schedule the FP date with directions they gave me to folloe but dont mention any rejection.

What does rejection of FP mean. Since I got FP notice

I485 processing date in Charlotte, NC

While the processing date for I130 is still stuck on 11/1/2001 in NBC/MSC, I checked the I485 processing date in Charlotte today, to my surprise, it is processing May 30, 2004, is it REAL or just another mistake?

If it's real, what does that mean? Will my files be transfered back to Charlotte since my notice date is Oct 27, 2003? Or it has to wait until I130 got approved first?

Thanks.

I485 processing date in Charlotte, NC

I am not sure but I think we have to wait until the I130 gets approved . We filed in the Vermont service center and the date it show there is 1/13/99 . I wonder if after we get the Immigration visa number we can just apply for change of status .

My Timeline Is as follows Married To Greencard Holder Jan 19 2001 Filed I130 Same Month While My Wife Filed For Us Citizenship She Swore In Sept 2003 Upgraded My Petition Got I130 Approved October 2003 But Didn't Recieved Notice Until Nov Filed I485 Jan 2004 Got Notice Date Feb Without A Priority Date Did Finger Prints In March (early Fingerprint) Got Ead Approved In May Awaiting News On I485. Online Status Says Recieve Fingerprints And Processing has Resumed On Case.called 800 Number They Told Me That Even Though My Case Says Msc I Should Follow The New York Dates But It Makes No Sense To Me If My Case Is At Msc Why Are They Holding It Until Dates In New york Gets Current To My Application I Thought they Said In The First place that Cases Get Sent To Msc Because Of The Backlogs In New York And Other States So I Say If That Was The Reason For Those Cases Being Transfer Then They Should Adjucate Any Case That Gets Done. I Had Also Called Nvc And The Automated Service Said They Had Sent My File To Cis So In My Opinion My Case Should Be Ready To Be Adjucated. my case is 245i i came here without inspection
