My lawyer explained that it is ALL ABOUT INTENT. You mus NOT have ANY CURRENT immigrant intent to remain in the US. If you had intent in the past, that could have changed you do not have it any more
and you will depart the US when you are expected to. Future intent for purpose of visa should be non immigrant as well. Hope that helps.
