E-2 extension in the U.S

Hi everyone,

I'm new at here and really need your help.

1. I'm from Japan and working for Japanese company in the U.S, and my visa is E-2.
2. The company has several restaurants in the U.S.
3. The company decided to shut one store down, because its business is not good.
4. The company gives me this store at no cost.
5. I will leave (quit) current company and take this store over, then start my own business.
6. The company has 10 years lease contract at that location and remain 6 more years. so I"ll have a sublease contract with my company.
7. The company agrees that A. I'll take this store over at no cost, B. I'll leave the company, C. I'll have a sublease contract.
8. I asked a couple of lawyers and they said A. I have to go back to Japan once, B. I need at least $200,000 budget to invest, C. I must apply new E-2 in Japan.
9. Only one of lawyer said that if I have $40,000 in personal assets and $15,000 investment into a business, I'm able to extend my E-2 in the U.S.
10. The store I take over has more than $40,000 value and I have $50,000 budget to invest into my own business.

Is that possible to extend my current E-2, or apply "NEW" E-2?

If you have more information about E-2 extension, please let me know.
