DS 230 Part 2 questions

Hi Alren, Raju and others -

I have two questions for the DS230 Part 2 for my wife and son.

1. Both are on H4 and have a Tax Identification number. I believe that is not the same as SSN. Or is it the same? If not same, then Q33a - Have you ever applied for SSN - Should I check "NO" ?

2. Q # 29. Is my employer also the petitioner for my spouse and son?

1. you are correct...TIN and SSN are two separate things. TIN is issued by IRS and SSN is issued by SSA. I would check 'No'.

2. Based on what I have read on this forum, different folks have put down either the primary applicant's employer information or the primary applicant's name itself or simply just left it blank. If I recall correctly and we will wait for alren to respond...but alren left it blank in his case. If my memory is right abt alren...his immi life is an open book and everyone knows the details...also goes to show that he is very open and willling to help others.

Q 1: You are right, ITIN is not SS Number. In the case of your wife and son
it would most probably be a 'NO'.

It would be a 'YES' for the question 'Do you want to apply....'.

It would be a 'YES' for the question 'Do you want the SS Authority to
be informed.........'.

Q 2: The following is what I was advised by my attorney to do and what I did.

Wife:
M/s xxxxxxxxx (sponsor for Mr.yyyyy , Husband)
Address

Daughter:
M/s xxxxxxxx (sponsor for Mr.yyyyy , Father)
Address


where, M/s. xxxxxx is my sponsor company.

I personally believe there is infact an answer to this question and the above
is the appropriate answer considering the fact that the dependents are deriving the benefit from the sponsorship of the Company.

I think the words should read something like ...
derivative benifciary of XXX's immigrant petetion filed by YYY company.

My attorney left it blank for my spouse's case.
