Detention of Overstay

Any suggestions as to how to proceed regarding the arrest and detention of an overstay? Petitioner is married to a USC who has left her 'high and dry'. All suggestions as to how to proceed to provide any help are welcome.

with usc is it still overstay, check on VAWA GC
