Substitution of LC/Pre-approved LC

Hello All,

How and when can a pre-approved LC be used?

My LCA (CA/EB3/RIR) is pending at Dallas BEC (PD : 12 March 2003). My company has a pre-approved LC (EB2, Masters + 0 yrs) that is available to be used.

I am eligible for this (I have a Masters), but would like to know the pros and cons of this before I start bugging my boss.

Any guidance/suggestions on my situation are sincerely appreciated.

Lc4ever,

I assume a congressional inquiry would entail contacting your congressman and have them ask about your case on your behalf. Search your congressman website, instructions on how to contact them are probably there.

That aside, I would try a simpler route first. I would have your HR write a letter explaining the error and attaching photocopies of the original ETA750 or delivery receipt. This may be all you need

(I just sent in my 7-th year H1B extension last week, I am hoping I don't have to do it next year. It's a long way to get GC.)

Hello all,

Just got my response from Philly center and my status is Data Review.

My PD is Jan 2003, 45 day letter was received and responded in mid April.

All the information is correct. Processing type is RIR and Case Received Date is 4/30/2005 (where this date coming from?). I assume they have received 45 day letter response, otherwise it would have been closed? Or they still have not entered the response (which is 4 months ago) into the system for PD of Jan 2003 case?

Just to share my case info with you all so we could have a more realistic expectation.

I suggest that you run this by your lawyer. They might want to re-send the reply to the 45 day inquiry.
BTW, which center did you get the screenshot from, and how long did it take them to reply? Did you say that it is for H1B extention?

I have the same situation. i received and replied the 45 day letter in January. My case status was "Data Review" in screen shot.

what is the date submitted in datareview section?

Please do share if you find something? or what was your lawyer's reaction?
per my lawyer there is nothing to worry about but I am concerned about it.

I am not so sure

I got a screen shot on 22nd July (a genuine case as I was renewing my 7th year H1B).

The screen only shows one third of the case event, I am estimating based on the position of the scroll bar.

At that time the "case status" field in my "Case Information" box has the status of "Data Review".

Only 3 lines of the Data Review box are visible with 6 fields showing:

So the 45day reply is acknowledged.

Surely Data Review is the case being reviewed...not just a failure to respond to the 45 day letter

That’s all I can read in the Data Review section of the screen shot

The Existence check doesn’t worry me…this is well documented on the forum

My PD date is 11/25/2002
I am guessing the Date Signed field has to do with the initial filing.

The other date of note in the case event log is
Case Received Date 11/15/2004
Processing centre Dallas Backlog Processing Center
I guess that was the date the box my papers were in, were keyed into the system

It’s been a long time, this coming Sunday (21st) marks day number 1,000 for me, it’s hard to see the humour when they were quoting around 90 days to process an ETA750 before 9/11.

I am preaching to the choir here because we are all in the same boat, so good luck to all.

They say that “anticipation is half the fun”….but I guess they were only referring to sex….

i received my hardcopy...in the mail today. the certified date on hard copy matches the date submitted on screen shot....so all of those who have "Certified" on ur screen shots, now can rest assured that the date submitted is your certified date and your LC hard copy will show up soon ( mine took exactly 1 month)
