20 day wait period

I guess i was misinformed....the 20 day wait period is for ALL citizens of muslim countries regardless of religion. I just have to patiently wait here in Malaysia for the 20 days. :(

Advice Appreciated - Preparing for H1 Visa Stamping

Hi Tung Fong, I believe we have crossed paths before in this
thread. Let\'s all work together and stay informed :)

I am a Malaysian citizen and Australian permanent resident. I
was in the US on a J-1 visa (applied from Australia). Recently
change of status to H-1B was approved. I will be heading to
Australia soon to get my H-1B visa. I contacted the consulate
there and was informed that a 20-day delay + interview is likely
due to my Malaysian passport.

Will update everyone on this thread on what happens. I have with
me:
original I-797 approval notice
copy of entire I-129 application
copy of LCA certification
offer letter from company
US bank account statement
US IRA account statement
W2 for 2001
2 most recent paystubs

If anyone can suggest WHAT ELSE might be required, that would
be greatly appreciated (besides DS-156 and DS-157, of course).

FunkStar : Thanks for your input and your experience would be of great help to everyone here. I think you have all the documents required. Make sure you surrender your new I-94 from your I797. I\'ve heard horror stories of people who did not.

Srikanthsiva : Any update on your stamping at KL?.

I have postponed my trip back home due to a new project. But I will be heading home, hopefully, at the begining of Feb.

Anyone with who are in the same boat, please feel free to comments, ask questions or just drop a few line to say hi as there are very few Malaysian on this board. I\'m going thru my GC process now and I will also post my entire expereince here once I\'ve got my GC. Currently I\'m also participating in the I-140 and CP thread.

Update: Experience in Malaysia

Hi all,
This is a friend of mine\'s experience at the US consulate in
Malaysia.

He gave them everything that was needed. He had to fill up an
additional form (this might be the DS-157 that aids in the
background check). He handed in the form and that was the only
thing they took away from all his submissions. Passport, H1
documents, etc were returned and he was told to come back in
20 days. (The DS-156 may not have been taken, I am not sure...)

Thank you for all the updates you have posted on this thread. I\'m really sorry to hear about you situation. I guess that\'s one of the thing I have to worry about too when I go home. I strong suggest you seek an immigration lawyer IMMEDIATELY and convert your status to H4 or other status because with recently Mr. Hernandez one of the director at INS has expicitly said that there is NO grace period when it comes to H1 termination (http://www.usvisanews.com/).

Srikanthsiva, I am very sorry to hear that. It is terrible that your
company has just cut you off while you were still trying to get
back to the US.

This is my experience at the US Consulate in Melbourne,
Australia. I am a Malaysian citizen, Australian permanent
resident.

Morning--went to the consulate terribly jet-lagged. Submitted
DS-156,157, original INS approval notice, copy of offer letter. Did
not submit W2, H1 petition, etc. as the person receiving the
documents did not specifically ask for them.

Was told to check back towards the end of next week. Could not
get any indication on whether 20-day delay would apply or not.
Could not get any information on whether other documents, or
an interview was required.

Was very frustrated, but am banking on the fact that I have written
confirmation from my manager that if necessary, I will be able to
work from home in Australia for three to four weeks.
 
Experience in Australia Part #2

I personally checked back at the consulate a few days later, and was informed that the 20-day delay would apply. No information could be provided if any further documents or an interview was required.

Proceeded to set up to work from home out of Australia, so far so good.
 
20 Working Days

I have been informed that it is 20 working days. I will confirm actual experience in several days time.
 
its 20 days including weekends!

I submitted my passport on the 26th and was told to come back on the 31st December....and on 31st december i was given back my passport and told to come back on the 18th of january. On 18th Jan, i resubmitted my passport and had to wait for 2 working days!
 
Experience in Australia #3

I have just received my passport with my H1 Visa. I initially
submitted my passport and documents on the 29th of Jan. I
received my passport in the mail around the 28th of Feb. Copy of
offer letter and INS approval notice were returned to me around
the 31st of Jan, with a letter informing me of a delay till at least
19th of Feb in processing time. At no stage was I contacted for
further info, interview, etc.

Thank you very much to everyone who has posted, given advice,
etc. on this and other threads.
 
Re-entry to the US O-K

Hello everyone!

I\'ve posted messages on this forum before indicating my concern upon re-entering the US from Malaysia. FYI, I am a Malaysian citizen and am currently an H1-B visa holder. I just came back from my trip from Malaysia/Singapore last Saturday and did not encountered any problem at all upon re-entering the states. I have a valid H1-B stamp on my passport and all I need to do was to fill up a new I-94 upon re-entering the US again. Hope this helps clear off some anxiety some of you might have if you\'re planning to gain re-entry back to the states.

H-1B stamp in Canada

I am a Malaysian citizen working in NJ. Just got my H-1B approval and was wondering if I can get it stamped in Canada since the 9/11 INS regulation changes? or do I have to go to KL to do that?

Hi Jean,

I am posting this out of my personal experience. Not sure if anything else changed but here goes...
I went and have my H1-B stamping in Vancouver, Canada in December 2001 (a few months after the 9/11 incident). There was no problem in my stamping at all. Just make sure you make an appointment with them at www.nvars.com, and get a confirmation letter from them.
Bring all necessary documents, and everything should be fine.
FYI, I also went back home to Malaysia about a month ago and came back to the states with no problem either...
