Change from F-1 to H-1 status

I was working in OPT (F-1 status) which expired on August 15th,2002. Though my employer had applied for H-1B permit during May 1st week with CSC, my case has not yet been processed and I have not been able to work since August 15th.
Since my F-1 status is now completed and I still have'nt obtained my H-1B approval, am I out of status ? Is there anything such as a max. gap that is allowed between changing statuses ?
