I hope one of the experts here can help me out with my dilemma. I am a Canadian citizen currently on an H1B working for a consulting company. I live in Toronto and work in the US for 4 days of the week. Although I am considered full time employee of the company, I am on a W2 Hourly, which means, I do not get paid when I take time off for vacation.

In the next few months, my company will start my Green Card sponsor. Given my current project will end in a few months and the next project may not start for another month, I am planning on asking for time off and travel overseas. During this time, I will not be paid nor will I be present in the US. Again, I am a Canadian citizen living in Canada and working in the US.

Can someone let me know if continued employment (meaning, continued pay) is critical for H1B or GC? If so, what do companies do in such cases to remedy the problem?
