can I get H4 stamped even when my husband still has not got his H1B stamped?

HI,

I originally came to US on F1 and then, transferred to H4 when my husband was transferred to H1B. My husband still does not have a stamp on his passport as he never got time to travel. Now, I want to travel to India, can I go to the Delhi Consulate with a valid I797 for the both of us, or would they require that my husband gets the stamp first???

Thanks, I would appreciate anyone sharing their experience in this regard.
 
In addition to I-94, please carry all documents related to his H-1. The most important ones are I-797, W2s, pay stubs, letters of employment, etc.
