can i file EB2 while i'm in backlog! Pls. help.

Hi all,
i've been going crazy for waiting labor all my life.
secnario:
my pd is aug. 2001 as EB3 category.
it is backlogged and now status shows in process and process type "TR" eventhough we applied as "RIR" in the beginning.
my lawyer sent email last january 20, 2007 almost twice no response to change process type until now.....still showing same process type and inprocess.

option:

i've been with company for last seven years.
i hold B.S. degree from U.S.
can i apply Eb2 category as my experience meet the requirements?
do you think this can go faster than waiting indefinitely for my previous category.
I don't have restriction on my Eb2 category for my country.
do you think this process would be faster?

i need all you guys suggestions. i feel like these days i can think making me crazy of this paper.
my wife is in H4 visa and can't do anything as she is on her way to pursue undergraduate from U.S.
so its very tough situation.

any suggestion would be great help.
 
Last month EB3 category LC got approved from BEC with PD Dec 20, 2001 (filed from CA EDD) for a known guy.
