the 10 day time period expires this friday, unless the president chooses to veto it, it will automatically become a law. here is what I read from murthy.com

"Once both the House and the Senate have approved the bill in identical form, it is sent to the President. The President can choose to take one of the following courses of action: (a) approve the legislation and sign it, thus enacting it into law, (b) take no action for ten days while Congress is in session, in which case it automatically becomes law, or (c) oppose the legislation and veto it. If the President chooses to veto the bill, Congress may attempt to "override the veto." Such action requires a two-thirds roll call vote of the members of both chambers. The President may also choose to "pocket veto" the bill, i.e. take no action on the bill after Congress has adjourned its second session. In case of a "pocket veto" the piece of legislation dies."

I applaud the House for working in a bipartisan fashion to pass legislation that strengthens border security while recognizing the importance of keeping families together and making America a more welcoming society. Many immigrants who are otherwise eligible to become legal residents will be forced to leave the United States and their families unless a temporary extension is granted. The Senate should act quickly to pass this legislation and send it to my desk for signature.

I thin we have to wait couple of more days.

On October 3, 2002, the Senate passed and cleared this bill for the White House. However, at the last minute, a bill was introduced by the Wisconsin Congressman for technical correction with this bill. The correction bill passed the House and sent to the Senate for consent. Please see the Congress record.
As people know, this U.S. Department of Justice authorization bill includes three important immigration legislations, including 7th year H-1B extension amendment, Conrad 30 Program for International Medical Graduates, and Investor Immigrant eligibility and removability amendments.
Since the Constitution requires that a legislative bill be signed by the President within 10 days after his receipt from the Congress, people have been nervous. The good news is that the technical corrections do not include any of these immigration legislations. Additionally, since the bill was not sent to the President on October 3 and not even until the end of last week, people do not have to worry about the fate of these legislations. could be this week or next week, important thing is it gets signed. there are no negative remarks that president might veto the bill, that is all I would worry about.

After this Bill becomes law. How long do you guys think it will take to come into affect?
 
The house has adjourned for the elections. AILA says this will not effect the pending bill. To my knowlege it still has not been sent to the White House so the 10 days has not started.
 
So will it become a law anytime soon?

Congress Recesses Until After November Elections, DOJ Authorization Unaffected

Unable to reach final agreement on a variety of issues, including the legislative language to create a Department of Homeland Security, the Senate decided late last week to recess until after the November elections. The decision means that Congress will have to come back after the November elections for a lame-duck session in order to pass a series of appropriations bills and to continue their work on the homeland security legislation. Congress is scheduled to return on November 12.

The inability to pass the remaining 11 appropriations bills for fiscal year 2003 forced Congress to pass a continuing resolution (CR) that allows the government to keep operating at fiscal year 2002 levels until November 22. Congress will return for the start of a lame-duck session November 12, when leadership elections and freshman orientation for new members are scheduled. As a result, the leadership in the House was skeptical that any work would get done before December. House Majority Leader Dick Armey (R-TX) said it was unlikely the House would do any substantive work other than approving another CR lasting into December, when Congress will try again to clear some appropriations bills and perhaps work on other legislation as well. For their part, the Senate has indicated that they will return to the debate over homeland security when the reconvene after the November elections.

Prior to the recess, Congress did reach a final agreement on the recently passed Justice Department authorization bill, which contains a series of immigration provisions that were noted in the last version of Washington Update. Due to the need for technical correction to the non-immigration related provisions of the bill, the legislation had not been sent to the President for his signature. AILA has been advised that these corrections have been made and that the legislation will be sent to the President shortly. The President is expected to sign the legislation into law.

Some of us at CA DOL thread want to send petition to senator, we hope to find out SF DOL's position on software related LC applications or any updates. If you have any advice, we'll really appreciate it.
By the way, I heard each state has a immigration specialist senator, how do we find out who is the immigration specialist among CA senators? Thank you in advance !
 
Is monday the deadline

The regulation was forwarded to president on Oct 23, according to 10 day rule if Bush does not sign by Monday 4th (not counting Sundays), then by default regulation would become a law as if the President has signed it.

Is my calculation correct ?
 
Iam all excited to hear this New Law being passed by the senate and also the Long awaiting signature by the president!!!!
