I had filed a H1 extension petition in April 2007 (My H1 expired on June 30, 2007). This extension petition was approved and my company got a new renewed H1 petition. However the name of the company was printed wrongly and so my company returned the new H1 petiton to USCIS for corrections.
Meanwhile, I returned to India in June due to official reasons (my company has offices in both India & USA) and have been working in Indian office ever since.
Now, I have a new assignment in USA starting October 1, but have not received my new (corrected) H1 petiton as yet. My company wants to apply for a "B1 in lieu of H1" type of B1 visa and send me to USA asap.
Any experience with "B1 in lieu of H1" visa? Does this risk the approval of the actual H1 petition in anyway?
Please help me asap.
