Automatic Visa Revalidation Rule Change

The U.S. Department of State amends this rule effective April 1, 2002. Due to the need for greater security screening of visa applicants, the Department is amending the provision for automatic revalidation of expired visas for nonimmigrant aliens returning from short visits to other North American countries or adjacent islands to exclude from its benefits (1)aliens who apply for new visas during such visits and (2)aliens who are nationals of countries identified as state sponsors of terrorism. Currently, the designated countries are Iraq, Iran, Syria, Libya, Sudan, North Korea, and Cuba.
It is extremely important that the third country nationals in the U.S. visiting Canada/Mexico for application for change of nonimmigrant visas at one of the American Consulates carry with them a "valid" visa. Otherwise, should the visa application be for any reasons denied or failed to be adjudicated, they will not be able to return to the U.S.
This change does not affect the TCN who visits Canada/Mexico for less than 30 days, for instance, Niagara Falls, for purposes other than application for a new visa at the American Consulates in Canada/Mexico.
