Hi, all,

I just received emails from USCIS and both my wife and I got I485 approved.

Thanks a lot for all your help during this long process.

It's my understanding that once you receive RFE for your I485, it won't take long to get your case approved.

Also, these days, it seems to me that if either of your case or your spouse's case is not ready to be approved, USCIS won't even touch any of your cases.

The RFE is about employment.

When I applied for my I485, my H1B extension was pending. RFE asked for the employment document for the period of my H1B extension. We submitted the H1B extension approval I797 document.

That's it.

it's with mixed feeling to read this post.

Extremely happy to see one more old-timer (Fiveice, along with allebe and other folks who concur filed 140/485 in late 03) get freedom! On the other hand, sad that a few of us still have to sit tight here in this endless waiting.

Fiveice - come back this forum a few more times to hang out with us. :) The fond memory of Allebe's weekly 140 case scan report will be on my mind for years. You guys are terrific! By simply being here, you give us hopes that one day it will come to us as well!

There is always hope. I know it's easy for me to say this now, but that's the truth.

When I saw other people got their cases approved and mine was still stuck somewhere, I was always wondering when my time would come.

After almost 4.5 years' waiting for my case, I am starting to believe that all our time will come and it typically takes about 4 - 5 years for the whole thing.

All those very early approvals and very late approvals are just special cases.

If your waiting time is less than that range, it's just normal.

As a matter of fact, my attorney told me this in the very beginning of my labor certification process.

So keep your hope for the best.

EB2 Not many approvals !

In EB2, we are not seeing any progress on approval front. Are people not reporting or the cases are not there or cases are getting approved ? . Any idea ?......

sunny27, if I remember correctly you are just like me among a few people stuck in name check for a long long time, your PD will be current in April. Have you heard anything about your NC? Wish all of us luck!

My lawyer did the status inquiry for me back in Feb, 2006 when my PD became current. The response was the same as yours.

It seems that increased security may not be equal to name check since my name check might have been cleared at that time.

If you are sure your name check is still pending, I can wish you good luck.

fiveice, thank you so much. I used to wonder if name check and security check were the same. Just a month ago, I got a letter from our senator's office once AGAIN confirmed that my case is STILL pending with FBI. So I guess name check and security check are the same. Congradulations to you and enjoy your freedom!

congrats on your approval.

I have a question, thanks in advance to any one who answers. what time is right to check the status of your Name check. should it be done when your priority date becomes current or even before that. Emailing FBI, I guess is a waste of time as they don't respond for atleast 8 months. Is it good to have a congressional check before priority date becomes current or better wait till it gets current.

please let me know your thoughts.
 
Hi,

I sent out an email to FBI long time ago to check my name check, but never got any response. I didn't do anything else. The NC just cleared itself.

From different posts in the forum, it seems to me that the only effective way to find out the status of NC is through congressmen although some people found it out through infopass appointments. But it really depends on your luck whether they can ask FBI to speed up your NC if it's still pending.

Here is my thought to whom may concern, stuck in name check is a very unfortunate matter, only a very small percentage of people will be lucky enough to be part of it. So don't worry about it too much unless you PD is current or close to be current and you don't see any action with your case. But once you get stuck, you will never know when you will be able to get out, almost nobody can help, even the congressional intervention won't help much. It doesn't hurt to contact congressman about it though. Like me, I did it twice already, nothing happened so far. I just cross finger and pray! Wish me luck!

I did second enquiry and got following reply " Your applications/petitions are currently pending, we will inform you when a decision is made. Thanks for your patience. ".

I have asked my company to approach to congressman to see the status but he replied that wait for PD to become current and then we will see how it goes.

Don't know, sometime I think, I should approach to congressman to see if name check is cleared and sometime I think to take advise of company lawyer and wait till PD becomes current.
