I am H1b without stamping in my passport and My H1b extension will be around Sept.I filed I485 one month ago and I want to visit my parents next month.I will get my AP soon and if I use AP, I will lose my H1 status and have to use EAD to continue working here.If I do not use AP and go to Mexico and get Third Country Visa,I can keep my H1b status and do my extension three month before my first 3 yesr H1 expires.My question is:
1)Which way I prefer?Of couse,Third Country Visa is safe but costing while AP has risk that I will be out of status if my I485 get rejected.
2)If I use AP ,can I do my extending my H1b and change back to H1.
Experts,please give me light.Thanks!
