E. IMMIGRANT VISA AVAILABILITY DURING THE COMING MONTHS
The following projections are based on the demand patterns which are currently being experienced. Fluctuations in demand could alter such projections at any time. Therefore, they should only be used as a guideline of what might occur. Under no circumstances should they be used as a basis for making any formal plans prior to the announcement of the monthly cut-off dates.

First: Continued heavy demand may require the establishment of a cut-off date at some point during the fiscal year.Second: Demand during October and the first week of November has already used over 38 percent of the annual limit. It is hoped that the December retrogressions will return monthly number use within the target range. If not, further retrogressions cannot be ruled out.


Guys..what do you think. any speculation on cut off dates for EB1 for India and China?

After looking at trackitt and few people on this forum, it looks like we still have lot of EB1s waiting from last year.

Unless FBI namecheck issue is fixed, approvals will not be FIFO. We cannot even pridict visa dates going back without namecheck issue being fixed.

People generally do not care about namechecks and doing something. Especially EB1s. If everyone ( extraordinary ability people, scientists, multinational managers, professors) starts complaining, I am sure FBI/DHS/USCIS will listen.

I am guessing, that India China dates may go back to January or February 2007 to clear all old EB1 backlogs and because they have already issued enough EB1 greencards this month for the first quarter already. EB1C is taking maximum greencards from the quota. This is because it is being abused by lot of Indian companies by bringing employees (not the top management but mid and lower management) on L1 visa and filing for them. Nobody has complained about it yet and goes under the radar.
