Hi Guys,

I got three options from the DOL on Tue Dec 9 2003. My employer choose to re-advertise. Please give me your ideas and tips regarding the re-advertisement, and what are the other options i have after this. Is this is the end of the WORLD for me as far as Labor cert is concerned?.

Usually following are the three options given by DOL:

1) Re-Advertise
2) Withdraw
3) Amend the application

Most probably SESA/DOL thinks the recruitment effort shown by employer along with LC application was not enough to validate unavailability of US worker in offered position. They might have found problem with job requirement or the way requirement effort was conducted, or both.

One can use following guideline during re-advertisement:

1)First and most important, follow instruction from DOL/SESA. Do exactly they are asking company to do.
2)Post advertisement on dates given by SESA/DOL.
3)Send a certified mail to all applicants who respond back to the advertisement.
4)Keep log of all the interviews either conducted face to face or over the phone. Get a copy of call-log from local telephone company.
5)Try at least twice to contact applicants before rejecting them based on “not interested”.
6)Be precise and clear about reasons for rejecting applicants.
