Currently the 240 Day Rule (8 CFR § 274.a(12)) does not seem to include E-3 (Speciality Australian Workers).
I know the AILA has been lobbying for years now to have it amended to include E-3's (as well as H-1B1's) b/c we and our employers are subject to forced and costly interruptions in employment.
Does anyone know if E-3s can work past their expiration date if the employer has filed a timely application for an extension of stay?
