did 1st labor thru NY Financial firm in 2001 in Sept, still at state, got layoffed in sept 2004
applied another labor from NJ company and got approved but its eb3 in feb 2004
i have to wait for more time than you

I wanted to share the height of foolishness from INS. I've applied for the extention on my EAD and AP(I-131) in the last week of May'05 in on-line. I took the appointment from Maryland INS center for the Digital signature and digital picture for the EAD and I-131. Last week I got an RFE from INS on the picture(photo) saying that digital pictures are not allowed for I-131.

That means they have given an RFE for the picture they had taken saying that digital pictures are not allowed. Isn't this called HEIGHT OF FOOLISHNESS. Anyhow I will take a picture from SEARS and send it back to them.

In fact this is my 2nd GC process, first I-140 approved but got laid off from the job at the righ time back in 2001. This time including substitution, denials on 7th yr extention and RFEs and murthy's attorney fee I spent so far more than 22k (whether u believe it or not...just for 7th year ext it costed me including premium processing - 11k).

Substitute labor EB2
I-140 filed on Feb'04 - RFE Mar'05, response on Jun20th - Approval...???
485- May'04 - Approval ????
2nd EAD - Approved - Jun 20th
 
No FP Received Message Yet!

Hi,
I did my finger print on July 5 and the LUD got changed on 7/5 and 7/6 then after 13 days it again changed on 7/18 and today 7/19 but no change in message, it still shows received status ? Any thought s why this...?

- Copy of the Confirmation Receipt notice
- Copy of Current EAD (Front & Back)
- Copy of I-485 petition (Adjustment of Status Application Pending with TSC)
- Online Status of my I485 receipt
- Copy of I-140 Petition
- Copy of Previous EAD mailer
- Copy of last approved Advance Parole document
- Copy of I-94
- Copy of Birth certificate
- Color copy of Passport (which has Bio-graphic data)
- Color copy of Driver’s License


Or if I send in the photos along with the letter which I got from USCIS..

Last time my attorney has applied, but this time I'm doing it on my own. Any help in this matter would be appreciated.

August Visa bulletin - No EB2 backlog

The August visa bulletin has been released and the good news is that there is no backlog for EB2 category.

Well, I guess USCIS did not approve many EB2s in July and hence there was no reason for backlog. Hope USCIS employees are back from vacation now and they can get with the program of approving GCs.

I saw the visa bulletin on Shusterman's site at

I replied for my RFE with the following and it got approved.

1. cover letter.
2. The notice which I got from USCIS.
3. Photos. (Enclose the photos in a glassine or paper envelope and staple the envelope to the notice. DO NOT staple through any part of the photo).

I hope this helps.

submission with a RD of 07/12/2004. Don't know when the I-485 will be
approved. Looks like VSC is hibernating in the summer.

I think maybe there is some difference because it should be FIFO, but who
knows what happened in INS. Anyway, the luck is the most important, and I
means it will depend on which officer is processing your application and other
unknown factors.
From your signature, you should be from VSC, too?

I did not raise any inquiry. Maybe next week or month I should raise an
inquiry.

Am from VSC. But my question was that our local ASC processing dates for 485 shows as Feb '05, I was wondering about that, hoping that maybe we'll hear something soon, as VSC is processing RD of 19th August and our ASC is at Feb '05. Either way, not keeping much hopes of getting anything soon, esp. the rate at which they are processing applications in the past few weeks.

new processing dates published...i guess it is kind of same as earlier post ..i think VSC folks are enjoying with summer vacation.

Any progress on your I-485? Your approval would bring some hope that VSC is actually working these days. They moved 7 days in a month :mad: .

From this, it is obvious that VSC approval pattern is erratic. So one can't draw any conclusions.
 
Regarding Biometrics - Help

This question os for a friend who is struggling with a dilemma.

My friend (EB3) had his 140 Approved more than a year ago. He completed his fingerprinting June of 2004. He is EB3 and hence was affected by retogression. He was thanking his stars as he had 1 year time to find the girl of his dreams from India. He found her (from india) and has planned to get married in September 2005. He is in the 7th year extension on his H1B. If he visits home he will have to apply for a H1B Stamping. So he has a consulate appointment for Sep 2005.

Here is his testing time. Things turned for the worst. He just received a notice to do Biometrics and is scheduled for August 2. If he does his Biometrics he is worried that before his marriage he might get his 485 approved.

What is his best approach to delay his 485 approval by delaying his Biometrics? How long can he postpond the Biometrics ? Can he request that the biometrics be rescheduled more than 2 months? Esp. because he wants to add his wife on the proceess. He is willing to get marriedo sooner, but the problem is he doesn't have an appointment for his wife's H1 Consulate appointment. He is trying to see if he can add her to his appointment at Chennai Consulate?

Would appreciate your help.
