Employer not giving I-485 reciept Please help

Your employer is probably not very familiar with the immigration law. 485 belongs to you adn they have no right to hold it. In doing so they are violating the law. In fact, your attorney who filed the 485 has the legal obligation to give you the 485 receipt. If they failed to do so, they...

BAD news guys...1932 is almost dead..

eBhola & Nadi, You guys are right in that until you get your GC, with your EAD you can do anything, AS LONG AS you immediately start working for your GC sponsor at a position as specified in your LC! Otherwise, your GC is not bona fide and considered fraudulent. There have been reported...

BAD news guys...1932 is almost dead..

Nadi, on the subject of AC21 portability you are very much ill-informed. AC21 portability is only applicable to switching a job with identical DOL categorization. In the case of developer -> managerial career change, even within the same company, AC21 is not applicable. If a person does...

Lets Send Massive Emails To Lou Dobbs, Here Is Why!!!

Lou Dobbs loves immigration as much as Bin Laden loves democracy. Read his book "Exporting America".

Let's hire a lawyer and fight back ? October 2005.

The visa quote is set by the congress in the form of LAW. Hiring a lawyer to sue the congress is as sensible an idea as trying to invent a perpetual motion engine: it simply defies logic. Also, the congress does not answer to immigrants. So as far as "pressure" is concerned, as immigrants...

Let's hire a lawyer and fight back ? October 2005.

And what/who exactly are you going to fight? USCIS and DOS do not create the immigration law, they just execute it. Those PD cut-off dates are the logical and mathematical consequence of the LAW. At this point, the problem is a political issue, rather than an administrial or legal one...

    Receive third fingerprint notice

In light of the new Visa Bulletin, I am guessing all the October FP notices have been sent out as a big joke at our expense, especially for those who initiated inquiries to the USCIS. I can almost see the gleeful smile on the face of the USCIS officer when s/he sent out the FP notice.

NSC Report out and now processing 06/01/04

Khajoor is right. Aila is usually a couple of days ahead of uscis's website. Let's hope USCIS does not change the dates by the time they publish it on their site. It's time to call in with inquiries. Here's the link http://www.aila.org/content/default.aspx?docid=17386

Eb2/eb3 Victims - Last Minute Remaining - Last Chance - Please Help

Touche. Confession: I am from a traditionally suppressive culture and consequently I do have a tendency to over-emphasize the dark side of things, especially before I have my morning cup of java. Afterall, with all its Tancredos & Dobbs this country is still the most compassionate...

Eb2/eb3 Victims - Last Minute Remaining - Last Chance - Please Help

You know, my friend, media only works to advance the public's will, satisfy the public's curiosity, or at times, fulfill the public's conscience. With the current economic and political atmosphere in this country, I highly doubt the American public give a dxxx to the unfair treatment of H1-B...

Eb2/eb3 Victims - Last Minute Remaining - Last Chance - Please Help

Dear srinireddydgl and a few other guys promoting similar cause: I think you guys have a fundamental misunderstanding of how things work in this country. The retrogression is merely the legal consequence of the visa number quota system, which in this country has been a long-standing...

    AC21 Eligible??

You can definitely change job after 485 approval. But since you will not be working for your GC sponsor, your GC application becomes "false representation", in other words, fraud. If INS somehow decides to come back to follow up on your case, they can use this argument to revoke your GC. This...

Good news EB3 relief passed in senate

Depending on what you want to achieve, writing to a legislator can be a very mis-informed and mis-guided move. Prior to the current retrogression, some people used to write to local legislators to complain about incompetencies of USCIS. This tactic sometimes worked since the slow processing is a...

    I-485 approved 1 day after 140

Always nice to bump into another fellow human being with a penchant for phrases like "transendental idealism". :-) I so look forward to the days when I can spend my after work hours pondering and discussing Kant, rather than USCIS. At the time being, idealism to me means to transcend...

    What to do ?

Call NSC first. They should at least approve your 140. Then ask your attorney to open an official inquiry for your 140. You RD has long passed the published processing date to justify an official inquiry. According to NSC's own policy, they should adjudicate your 140 righ t now.
