that is interesting. So far, i was under the assumption that either if you use EAD for employment or use AP to enter US, your H1B status will be gone. (irrespective of what your HR considers for tax processing)

I have filed both I-140 and I-130 - one thru my employer and one thru my spouse- and i dont think it will create any problem. The problem comes when you file I-485 thru employer and thru family relative. In such case INS would ask you to withdraw one of the I-485 applications.

I got lil confused with how the process of getting EAD works. Some people say that they got EAD thru mail and some say that they went to INS office to pickup the EAD. Will we get the EAD thru mail or should we go and pickup the EAD ?

How easy is it to file the forms for the marriage based green card?
It is very easy to prepare the marriage based 485 application. There are forms that you can download from USCIS website. especially if you have filed your employment based I485, you can pretty much reuse the same information...
As far as i know, it takes approximately 6 to 9 months in southern california. Filing by yourself or hiring a lawyer will not going to make a big difference in the processing time.
The USCIS website will give you the processing dates.
