After carefully weighing the options, I have decided to wait and file and EB2. It seems to be a far safer option and also being fair to Family don't want to move them back and forth etc.

I was thinking about that option. However, the 3 year bachelors degree from 17 years back comes in the way ;-)
I just completed my masters - maybe will wait a couple of months and then file EB2.

Thanks much for the insight. Its very good news - I will probably try this route. Since anyway I am managing a significantly large global team. Slowly losing faith that this EB3 will make it anywhere.

As for Point 2 - I just completed my masters hence the experience + 3 + 2 years of education not sure how that works. As for my current job and pay - I would say I am more than comfortable. Let me check with the company lawyers and see what they say.

I have an EB3 labor substitution with PD Aug 2003.
I just completed my masters this month - My company is supporting filing EB2 and I485 interfiling. The company's financials are solid.

As long as they are ok to not pull ur 140 and you are absolutely certain about it - you should be fine. Again, its my opinion - I am traveling on AP frequently for the last 4 years - Thats what I would have done. Go back - have fun ;-)

I believe it was bush who did the 245(i) in April of 2001. Not sure, not that it matters, this April 2001 data has come back to screw me many times over in the last eight years.

my PD is Aug 2003. I've been on EAD since Feb 2005 ;-) - I was hoping for some movement here - Not sure if it moves back a little and then move forward. Usually check once a year around Oct/Nov. I hope jackolantern is right on this one.

Even though this is very possible to do - "If you do an interfile then you automatically get to keep your earlier priority date of Feb 02.". Positively check with an attorney on
See if you are eligible for this since the labor you used to file your original I140 was based on substitute labor...
Do not bother about the date shown its probably a mistake. you can always have it corrected even if it isn't. My cousin had the same issue and he got it corrected.
As for the interview, in all probability it was the arrest record that triggered the interview. Focus on that and take all papers...

EB2 pushed to 2000. EB3 in all probability will be pushed back to 51 BC.
