According to my attorney, the AAO does not issue the receipt notice. Mine was sent out to the AAO a month ago and I have not received the receipt notice.
I was told that current means within 30 days (or even 2 months). They begin to review your application immediately right after receiving it. But, I see many peoples in this forum still waiting for more than 4 or 5 months. Not sure if we can rely on their definition of "current."
I'm also very curious about my application status filed to AAO... My case is little different from yours. My attorney sent the application directly to the AAO. He requested for a 60 days extension and did not request that NSC reviews the application. So, it's sent to the AAO at the end of March...
My appeal (NIW) was finally filed to the AAO last month and I have not gotten the receipt notice yet.
My attorney said that we would not expect the receipt notice from the AAO which is inconsistent with this forum. Some people receive the receipt notice from the AAO.
Also, how do I...
Good point! I should have checked it. Thanks for it. By the way, my attorney told me that the USCIS does not provide the receipt for the appeal. Not sure if this is correct or not.... anyone can confirm it?
According to the processing time release report (3-23-06), the NIW processing time at the AAO is current, meaning you'd get their decision within a month.
Erics,
I accepted the suggestion from this forum and hired the attorney and since Jan. I've been working with the lawyer.
I don't know how and why I have a 60 days extension of NIW appeal to AAO. That was done by my immigration attorney and he said that the deadline given to submit the...
No, I'm not from a retroprogressed country. What do you mean by "a minimum of 61 days to apply PERM?" Is that from the date that job search advertising is appeared on newspaper or Web site?
Of course, I can talk to Legal Council (HR does not deal with immigration at our university) about it. But, I doubt it.
I'm appealing the denial decision of my NIW (NSC) to AAO and will have it filed at the end of this month. AAO processing time is about 6 months, I was told. I was going to...
I'm working at one of the State Universities and have a contract yearly. I don't think univ would cancel my h1 visa and revoke the contract signed. That's risky for university to do that. They may get sued against discrimination. They may not renew the contract, but it's also risky without...
It sounds very unfair and illegal. Are you sure this is legal and correct? I just can't believe that. That shouldn't be right. No justice at all??? So, for example, if I don't get along with my boss, then I'd better leave the employer? Canceling my existing h1 is i think a violation of the...
Sorry that my question is unclear. I was trying to say whether or not employer can "refuse to file the H-1B extension application "while 140 is pending."
My H-1b expires in October 2006 (less than 7 months) and I wish to file the H-1B extension while my NIW 140 petition is in pending.
If I get a job offer in May, do you think I still have a chance to get stayed in the U.S.? I'm teaching at university (with Ph.D.). Based on what you said, it would be difficult to get I-140 approved before Oct. this year. Am i right?
Hello Everyone:
We are in the U.S. and my wife have had several job interviews and finally got a job offer (on the phone) from two major hospitals in town but after knowing my wife is in H4 visa status the HR persons have been quiet. One hospital said it's pending and the other with long...
