When to file H1?

Case situation:
1. Job offer will start in July
2. H1 application can be filed only four months
before job starts.
3. H1 cap will be full in March

Question:
1. Will TSC accept H1 application now
2. Will Premium Service beat the 65,000 H1 cap?

Apply for premium processing H1 requesting a start date of July 1. Solves all problem.

I-129 says application should be turned in no earlier than 4 months before employment starts. If Premium Service can break this rule, would you please tell me if its CIS' policy or stand-alone cases? It seems to me TSC needs only 3 months to process H1 applications. If TSC rejected my application for time reason, will they return my $1000?

Yes, theoritically you are supposed to get the premium back if you dont get premium service.
